ODEON IMAX VR Purchase Terms and Conditions

1.             THESE TERMS

1.1.         What these terms cover.  These are the terms and conditions on which ODEON sells tickets for IMAX VR experiences at ODEON (“Terms”).

1.2.         Why you should read them. Please read these Terms carefully before you purchase a ticket. These Terms tell you who we are, how we will provide the IMAX VR experience to you, how you and we can end the contract, what to do if there is a problem, and other important information.

2.             ABOUT US AND HOW TO CONTACT US

2.1.         Who we are. We are ODEON Cinemas Limited (“we” or “us”), a company registered in England and Wales. Our company number is 1854132, and our registered office is at St Albans House, 57-59 Haymarket, London, SW1Y 4QX. Our registered VAT number is 241717672.

2.2.         How to contact us. You can contact us by using our Contact Us page at ODEON.co.uk or by writing to us at this address: ODEON Guest Service Centre, Odeon Stoke Cinema, Marina Way, Festival Park, Stoke on Trent, ST1 5SN.

2.3.         How we may contact you. If we have to contact you, we will do so by telephoning you or by writing to you.  When we use the words “writing” or “written” in these Terms, this includes emails.

3.             OUR CONTRACT WITH YOU

3.1.         How we will accept your order.  If you purchase online, our acceptance of your order will take place when we display the booking confirmation screen, at which point a contract will come into existence between you and us.  If you purchase at the experience centre, our acceptance of your order will take place when we issue a ticket to you.

3.2.         If we cannot accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for the tickets you have ordered. This might be because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the ticket.

3.3.         We only sell to the UK. Our website is solely for the promotion of IMAX VR at ODEON in the UK. We do not accept orders from outside the UK.

4.             ABOUT IMAX VR AT ODEON

4.1.         Experiences. The IMAX VR Experience is a virtual reality experience undertaken in a purpose-built room known as a “pod”.  Taking part will require you to wear a headset that completely blocks your view of your actual surroundings.  Some experiences require use of a handheld device. Some experiences are seated and require you to remain seated throughout the experience.

4.2.         Multi-player. Many of the experiences are multi-player. If other members of the public participate in the same experience as you, they may be in the same pod, or in another pod elsewhere. Members of staff supervise the pods and can see the same screen that you will be viewing, which means they can see the activity of all the “virtual” participants in the experience.

4.3.         Age restrictions. You must be at least 13 years old to experience IMAX VR at ODEON. Some experiences may have a higher age restriction. Proof of age with photographic ID may be required.  If you are under 18, you will need your parent/guardian to come to the experience centre with you, so they can complete a waiver form for you.

4.4.         Waiver form requirement.  Prior to the experience, you must read and complete a waiver form containing important health and safety information. If you are under 18, you must ask your parent/guardian to read and complete the waiver form on your behalf at the experience centre. You will not be able to take part in the experience without a completed waiver form. The waiver form is available for review at ODEON.co.uk/privacy-and-legal/odeon-imax-vr-waiver.

4.5.         Rating system.  IMAX has produced a rating system to help you choose the right experience for you. Each experience has an age rating, a content advisory (e.g. whether it contains bad language, adult humour, violence, etc) and a VR experience advisory (e.g. whether it involves extreme heights, jump scares, etc). Rating information is available online and at the experience centre. 

4.6.         Timing. IMAX VR experiences can vary in length. Please check the experience description for specific details. You must arrive at least 15 minutes prior to your booked time slot, to attend a pre-experience briefing. If you are booking multiple experiences, you must ensure you leave at least 15 minutes between each booking. Tickets are only valid for the booked time slot.

5.             PRICE AND PAYMENT

5.1.         Price. The ticket price will be as displayed during the purchase process. We take all reasonable care to ensure that the price of the ticket advised to you is correct. Displayed prices include VAT.

5.2.         What happens if we get the price wrong. It is always possible that, despite our best efforts, some of the tickets we sell may be incorrectly priced. If we accept and process your order where a pricing error could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.

5.3.         Payment. You must pay for your ticket when you place your order. You can only pay by using a credit or debit card. You cannot pay by any other method. We do not accept cash or cheques online or at the experience centre.

6.             YOUR TICKETS

6.1.         Tickets purchased online.  If you purchase online, when we have accepted your order, we will send you a confirmation email which contains your e-ticket. You will need to show this email at the experience centre.  You can show a printed copy or display it on your smart phone screen.

6.2.         Checking your tickets. Each ticket is for a specific experience and pod, and can only be used at the stated time and date. It is your responsibility to check your order carefully so you purchase the correct ticket.

6.3.         Tickets for personal use only.   We only supply tickets for you to use in your personal capacity.  Tickets may not be bought or used for commercial, business or re-sale purposes.

7.             YOUR BEHAVIOUR

7.1.         Why your behaviour matters.  Your behaviour at the experience centre can affect the safety and wellbeing of you, our staff and our other guests.  It can also affect the security of our property, and the property of our staff and guests. So we need to set some minimum standards of behaviour.

7.2.         Things you must not do

When you are in the experience centre, you must not do or attempt to do any of the following:

a)            behave in an aggressive, abusive, intimidating, anti-social or threatening manner, or behave in any way which may cause distress to our staff or other guests;

b)            seek to participate in an experience without having signed a waiver form and attended the pre-experience briefing; or

c)             use any camera, phone, tablet or other device capable of taking photographs or recordings without prior permission from a member of staff.

8.             YOUR PERSONAL INFORMATION

8.1.         How we will use your personal information. We will use and share your personal information in the following ways: (a) to provide any services and products you request, (b) to open, administer and run any card account or registration you have with us, (c) for customer profiling and market research, and (d) to provide you with marketing communications in accordance with our Privacy Policy .

8.2.         Your waiver account.  We will ask you to set up an online account with us as part of recording your completion of your waiver form. This is separate to any other ODEON account you may have. If you prefer not to do this, you will not be able to purchase tickets online, but you can still purchase tickets and sign the waiver form in person at the experience centre.

8.3.         Providing us with the right information. All the information you give in the waiver sign up process must be accurate and complete.  You must provide proof of age with photographic ID if we reasonably request this.

8.4.         Our Privacy Policy. Our Privacy Policy which is available at ODEON.co.uk/privacy-and-legal provides details of how we may collect and use your personal information, and the choices you can make about how your personal information is used.

8.5.         CCTV. Please note that CCTV is in operation at our cinemas for the purposes of crime prevention and public safety.

9.             YOUR EXPERIENCE

9.1.         Your rights. We are under a legal duty to provide IMAX VR experiences in accordance with this contract. The Consumer Rights Act 2015 says that you can ask us to repeat or fix the experience if we don’t provide it with reasonable care and skill, or get some money back if we can't fix it.

9.2.         Changes to scheduled IMAX VR experiences for reasons outside our control. We will always try to ensure that experiences take place in accordance with the advertised programme. However, we may sometimes have to cancel an experience, vary the time of an experience or substitute an alternative experience because of circumstances beyond our control.  If this happens, we will contact you as soon as possible to let you know. Provided we do this, we will not be liable for changes caused by an event outside our control, but you may contact us to end the contract and receive a refund for any experience you have paid for but not received.

9.3.         Circumstances when our supply of IMAX VR experiences may be suspended.  We may need to suspend our supply of IMAX VR experiences to deal with technical problems, or so we can update them to reflect changes in relevant laws and regulatory requirements. If this happens, we will contact you as soon as possible to let you know, and you may contact us to end the contract and receive a refund for any experience you have paid for but not received.

10.          CANCELLATIONS & REFUNDS

10.1.       Cancelling because of something we have done or are going to do. If you are cancelling your ticket purchase for a reason set out below, the contract will end immediately and we will refund you in full for any tickets which have not been redeemed and you may also be entitled to compensation. The reasons are:

(a)           we told you about an error in the price or description of the IMAX VR experience you have booked and you do not wish to proceed;

(b)           we told you about a change to the IMAX VR experience you booked because of events outside our control;

(c)           we told you that we have suspended IMAX VR experiences for technical reasons or so we can update them to reflect changes in relevant laws and regulatory requirements; or

(d)           you have a legal right to end the contract because of something we have done wrong.

10.2.       No cooling off rights. Please note that cooling off rights (right to change your mind) do not apply to your purchase of tickets for an IMAX VR experience at ODEON.

10.3.       Refunds.  Where a refund is due to you, we will do this as soon as possible. We will generally seek to make the refund back onto the card you used for payment. Due to system constraints, where you have purchased online, we will need you to come to the experience centre in person with the card you used for payment.  If this is an issue for you, we will work with you to find an acceptable alternative.

11.          OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

11.1.       We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products; and for defective products under the Consumer Protection Act 1987.

11.2.       Our responsibility for foreseeable loss.  If we fail to comply with these Terms, or fail to use reasonable skill and care in providing IMAX VR experiences to you, we are responsible for loss or damage that you suffer that is a foreseeable result of our failure. Foreseeable loss or damage can be foreseeable in two ways: either it is obvious that it will happen, or at the time you purchased your ticket you and we both knew it might happen.  We are not responsible for loss or damage which is not foreseeable.

11.3.       We are not liable for business losses. We only supply tickets for your own personal use. If you use the tickets for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

11.4.       Lost/stolen tickets.  It is your responsibility to keep your ticket safe. We are not responsible for any lost or stolen tickets. You will not receive a full or partial refund of any fees already paid in such situations.

12.          OTHER IMPORTANT TERMS

12.1.       We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation.

12.2.       You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these Terms to another person if we agree to this in writing.

12.3.       Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its Terms.

12.4.       If a court finds part of this contract illegal, the rest will continue in force. Each of paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

12.5.       Which laws apply to this contract and where you may bring legal proceedings. These Terms are governed by English law and you can bring legal proceedings in respect of your ticket purchase in the English courts. If you live in Scotland you can bring legal proceedings in respect of your ticket purchase in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of your ticket purchase in either the Northern Irish or the English courts.

12.6.       Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to use alternative dispute resolution. The European Commission has established a website for online dispute resolution which is available at www.ec.europa.eu/consumers/odr/, and which is designed to assist consumers in resolving disputes online without having to go to court.
